Rose Walker Settles Case Involving Death of Senior Citizen

$825,000 Paid to Son of Dallas Woman Who Was Struck and Killed by Furniture Truck

(Dallas) It was a referral case, one that found its way to Rose Walker due to the firm's reputation for taking tough cases to trial.

The victim's age might have been a problem. 90-year old Ira Daniel of Dallas had been hit and killed by a large truck. "It's a sad comment on society," says attorney Michael Richardson, who represented Mrs. Daniel's son, Kenneth. "We should honor and value our senior citizens, but the fact is, many plaintiffs firms wouldn't take this case because there was little apparent prospect of a large damages award."

"We took it because it was the right thing to do," says Rose Walker attorney Leane C. Medford, who also represented Kenneth Daniel. "And I'm glad we did because it gave us the chance to put our reputation and trial skills to use for a family that needed us."

As she had done so many times before, Mrs. Daniel left her Dallas home on November 30, 2000 to do her laundry at a local laundromat. Walking back, she passed through the parking lot of an apartment/condominium complex located just behind her own property.

She never made it home. A large truck, in the neighborhood to pick up household items and furniture, ran over her. She died within seconds.

At the time of the accident, the truck, with a gross vehicle weight of 15 tons, was being driven by Antonio Medina. Mr. Medina was working for The Estate Warehouse, a Dallas company specializing in the resale of household items.

Mr. Richardson and Ms. Medford filed suit against Medina, The Estate Warehouse and its owner, Robert Heindel, Jr. The wrongful death action alleged that the company had allowed Mr. Medina to operate the truck without the required commercial driver's license, and without proper training and supervision. Just prior to trial, the two sides settled for $825,000.
