MumboJumbo's Court Victory Over PopCap Now Worth $7.3 Million

Court adds attorneys’ fees to recent verdict following trial over fraud, breach of contract 

DALLAS – A state district court in Dallas has added attorneys’ fees to last week’s jury verdict in favor of premium casual video game developer MumboJumbo against rival developer PopCap.

Following a hearing in the 193rd Civil District Court in Dallas County, Judge Carl Ginsberg said he would enter an order requiring PopCap to pay $2.7 million in attorneys’ fees to MumboJumbo, including $525,000 for post-verdict appeals. When added to the jury’s award of $4.6 million, the total amount to be paid by PopCap now stands at $7.3 million.

Dallas-based MumboJumbo LLC is a worldwide publisher, developer and marketer of premium casual games for PCs and game consoles made by Nintendo, Sony Computer Entertainment and Microsoft Corporation. In 2006, MumboJumbo and Seattle-based PopCap Games, Inc., reached an agreement whereby MumboJumbo would produce, distribute and sell certain PopCap games in North America.

But last month, a jury found PopCap liable for fraud and tortious interference, and agreed PopCap had gone behind MumboJumbo’s back and decided to market and sell its games on its own. Attorneys for MumboJumbo used PopCap’s own internal e-mail messages to show how the company soured a business relationship between MumboJumbo and a key retailer.
